Arkansas Small Claims Court Filing?
I filed paperwork at the Arkansas Green County District Court Small Claims Division. The defendant received my complaint and signed for the certified mail showing he received it. My invoice was sent 7/20/2009 for $852.00. The defendant now wants me to send him a copy of my invoice with a explanation of charges. I have done this several times over 2 years with no response until I filed the complaint at the courthouse. I have made several trips to collect the $852.00 along with the $65.00 charge to file the complaint and other misc. charges. He has not returned an answer to the complaint as the District Clerk said he is to do by law. Should I wait his answer then send him an invoice with backup and proceed to court or send him backup before he answers the complaint with additional losses. I would like to recoup my other losses (i.e. filing fee, postage, trips to collect monies, lost office time, etc.) I feel he is now wanting to only pay the original invoice that is now 2 years old and resolve this issue. Any answers on this issue would be greatly appreciated.
